Terms and Conditions for Event Calendar App Usage
1. General Terms
1.1 These Terms and Conditions ("Terms") govern your use of L.A.D. Marketing Concepts DBA Central Oregon Local Live's Event Calendar App ("the App"). By purchasing and using the App, you agree to comply with these Terms. Failure to comply may result in suspension or termination of your access to the App.
1.2 The App is designed for businesses to manage their event calendars, send notifications, and offer event reminders to their customers via SMS or email.
1.3 These Terms are subject to change at L.A.D. Marketing Concepts DBA Central Oregon Local Live's's discretion. You will be notified of any changes via email or in-app notifications.

2. SMS Notifications and Usage Charges
2.1 The App allows businesses to send SMS notifications to customers regarding event updates, reminders, or other relevant information. These SMS notifications will be sent on behalf of the business by L.A.D. Marketing Concepts DBA Central Oregon Local Live.
2.2 Each business is entitled to send SMS notifications to up to 249 unique customers per month at no additional charge.
2.3 Once a business exceeds 249 unique customers in a given month who receive SMS notifications, an additional fee of $25 per month will be charged for every block of up to 250 additional customers. This charge will be applied automatically and added to the next billing cycle.
- Example:
- 1–249 unique customers: No charge beyond subscription fee
- 250–499 unique customers: $25/month
- 500–749 unique customers: $50/month, and so on.
2.4 Unused SMS notification capacity does not roll over to the following month.
2.5 Businesses will be notified when they are nearing the 249-customer threshold and will be provided with a detailed breakdown of the charges in their billing statement.
2.6 L.A.D. Marketing Concepts DBA Central Oregon Local Live will facilitate and send SMS notifications on behalf of the business, but the business is responsible for the content, frequency, and legality of the SMS notifications.

3. Billing and Payments
3.1 Payments for the App and any additional SMS usage charges will be automatically deducted based on the payment method you have provided upon registration. All charges are non-refundable.
3.2 Invoices for additional SMS charges will be sent monthly and will include a detailed breakdown of the number of SMS notifications sent and any applicable fees.
3.3 Failure to settle your account in a timely manner may result in suspension of your account and access to the App until the outstanding balance is paid.

4. Ownership of Customer List and Responsibility for SMS Content
4.1 L.A.D. Marketing Concepts DBA Central Oregon Local Live retains ownership of the customer list generated through the use of the App. By using the App, you acknowledge and agree that the customer contact details and related data collected for the purpose of sending SMS notifications are owned by [Your Company Name].
4.2L.A.D. Marketing Concepts DBA Central Oregon Local Liveis responsible for the content, delivery, and compliance of all SMS notifications sent through the App on behalf of your business. We ensure that all messages adhere to applicable laws and regulations, including the Telephone Consumer Protection Act (TCPA), the General Data Protection Regulation (GDPR), and other relevant consumer communication laws.
4.3 While L.A.D. Marketing Concepts DBA Central Oregon Local Live manages the content of SMS notifications, businesses must provide accurate event details and updates to ensure that the content is relevant and appropriate.
4.4 Any liability, legal claims, or penalties arising from non-compliance with SMS regulations or misuse of the messaging system will be handled by L.A.D. Marketing Concepts DBA Central Oregon Local Live, except where the business has provided incorrect or misleading information for the notifications.

5. Termination of Services
5.1 You may terminate your use of the App at any time. Upon termination, all charges incurred up to the point of termination will remain due and payable.

6. Limitation of Liability
